VoyTix Terms of Service

1. Eligibility

You must be at least 13 years old to use VoyTix. By using the Service, you confirm that you meet this age requirement. If you are under 18, you represent that you have your parent or guardian's permission.

2. Your Account

• You are responsible for keeping your password secure and for all activity under your account.
• You must provide accurate information when registering.
• You may not share your account or create accounts for others without permission.
• Notify us immediately at daronov@voytix.com if you suspect unauthorised access.

3. Subscriptions & Billing

• VoyTix offers a free tier and a paid Pro subscription.
• Billing methods: Pro subscriptions can be purchased directly via Stripe (web/card), or through Apple In-App Purchases (App Store) or Google In-App Purchases (Google Play), processed via RevenueCat. The billing method available to you depends on your platform.
• Free Trial: New Pro subscribers may receive a 30-day free trial when subscribing via Stripe. Trial availability for in-app purchases is determined by Apple or Google.
• Auto-renewal: Subscriptions automatically renew at the selected billing cycle until cancelled.
• Cancellation (Stripe): You can cancel anytime from the Account tab or through the Stripe billing portal. You keep Pro access until the end of your current billing period.
• Cancellation (Apple/Google): If you subscribed via the App Store or Google Play, you must cancel through your device's subscription settings (App Store → Account → Subscriptions, or Google Play → Account → Subscriptions). We cannot cancel App Store or Google Play subscriptions on your behalf.
• Refunds (Stripe): Subscriptions are non-refundable except where required by law. Contact daronov@voytix.com for billing disputes.
• Refunds (Apple/Google): All refund requests for App Store or Google Play purchases must be submitted directly to Apple or Google. VoyTix has no control over their refund decisions.
• Prices may change with 30 days' notice.

4. Acceptable Use

You agree not to:

• Use the Service for any illegal purpose or in violation of any applicable law.
• Attempt to reverse-engineer, scrape, or abuse the APIs powering the Service.
• Attempt to gain unauthorised access to any part of the Service or its infrastructure.
• Use automated bots or scripts to access the Service.
• Interfere with other users' access to the Service.

We reserve the right to suspend or terminate accounts that violate these rules.

5. Biometric Authentication

VoyTix offers optional Face ID (iOS) or fingerprint (Android) sign-in. By enabling this feature:

• Biometric matching is performed entirely on your device by the OS — we never receive or store biometric data.
• You can disable biometric sign-in at any time in your device settings.

6. Push Notifications

VoyTix may send push notifications for trip reminders, flight alerts, and daily plan summaries. You can opt in or out at any time through your device's notification settings. Disabling notifications does not affect any other feature of the Service.

7. Trip Sharing & Gifting

By generating and distributing a share link, you:

• Consent to a sanitized version of your trip being accessible to anyone who opens the link.
• Consent to any recipient saving ("claiming") a full copy of the trip to their own VoyTix account. Once claimed, that copy belongs to the recipient's account and cannot be removed by you or by VoyTix.
• Remain responsible for the content of trips you share. Do not share trips containing sensitive personal information (passport numbers, exact home address, etc.).

8. Viral Pro Reward

When a shared trip link receives a qualifying number of unique views, the sharer may receive a complimentary Pro period ("Viral Pro"). You acknowledge that:

• Viral Pro is a one-time reward per account.
• VoyTix may modify or discontinue the Viral Pro programme at any time.
• Artificially inflating view counts (bots, automated requests) violates these Terms and may result in account suspension.

9. Referral Programme

VoyTix offers a referral programme where users can invite others using a unique code. By participating:

• Rewards are granted only for new accounts that successfully sign up and meet qualifying thresholds determined by VoyTix.
• Rewards are one-time per qualifying event and non-transferable.
• Creating multiple accounts to self-refer or otherwise gaming the referral system is prohibited and may result in account suspension.
• VoyTix reserves the right to modify or discontinue the referral programme at any time.

11. Affiliate Links & Third-Party Booking Partners

By using any affiliate or partner link within the app, you acknowledge and agree to the following:

• No endorsement: The presence of a partner link does not constitute an endorsement or warranty of any third-party product or service.
• Third-party terms apply: All bookings made through external partner links are subject solely to the terms, conditions, cancellation policies, and privacy practices of the respective service provider (airline, car rental company, insurance provider, etc.). VoyTix is not a party to any such contract.
• No liability for partner services: VoyTix is not responsible for — and expressly disclaims all liability for — any issue arising from a booking made through an affiliate link, including but not limited to: flight cancellations or delays, car rental disputes, eSIM connectivity failures, insurance claim denials, transfer no-shows, pricing inaccuracies, overbooking, or any loss, damage, or inconvenience caused by a third-party service provider.
• Price accuracy: Prices shown in VoyTix are estimates sourced from third-party APIs and may not match the final price displayed at the time of booking. Always confirm the final price on the partner's website before completing a purchase.
• Dispute resolution: Any disputes regarding a booking must be resolved directly with the service provider. VoyTix cannot intervene, refund, or compensate for third-party service failures.

12. User Content

You may create, save, and share trip plans and itineraries within VoyTix ("User Content"). By submitting User Content to the Service, you:

• Confirm you have the right to share that content.
• Grant VoyTix a non-exclusive, royalty-free licence to store, display, and process your User Content solely to provide the Service to you.
• Agree not to upload or share content that is illegal, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable.

You retain ownership of your User Content. We do not sell or license your trip data to third parties.

13. Intellectual Property

The VoyTix name, logo, app design, and content are owned by us and protected by intellectual property law. You may not copy, reproduce, or distribute any part of the Service without written permission.

14. Limitation of Liability

To the fullest extent permitted by law, VoyTix and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service — including but not limited to missed flights, booking errors, insurance claim issues, car rental disputes, eSIM connectivity failures, airport transfer problems, or reliance on AI-generated itineraries.

VoyTix is not responsible for the acts or omissions of any third-party booking partner, airline, hotel, car rental company, insurance provider, eSIM provider, or transport company. Use of any affiliate or partner link is entirely at your own risk.

Our total liability to you for any claim arising from the Service shall not exceed the amount you paid us in the 3 months preceding the claim.

15. Account Deletion

You may delete your account at any time from the Account tab in the app, or by submitting a request at /account-deletion. Upon deletion, your personal data is permanently removed within 30 days. Stripe-managed subscriptions are cancelled automatically when your account is deleted.

16. Changes to These Terms

We may update these Terms from time to time. Continued use of the Service after changes constitutes acceptance of the revised Terms.

17. Apple App Store — Additional Terms

If you downloaded VoyTix from the Apple App Store, the following also applies:

• These Terms are between you and VoyTix only, not Apple. Apple is not responsible for VoyTix or its content.
• Apple has no obligation to provide maintenance or support services for VoyTix.
• Apple is not responsible for any claims by you or a third party relating to VoyTix, including product liability claims, consumer protection claims, or intellectual property claims.
• Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you upon your acceptance.
• Your use of VoyTix must comply with the Apple Media Services Terms and Conditions.

18. Google Play — Additional Terms

If you downloaded VoyTix from the Google Play Store, your use is also subject to the Google Play Terms of Service. In the event of a conflict between these Terms and the Google Play Terms of Service, the Google Play Terms of Service governs with respect to your use of Google Play.

19. Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles. Any disputes shall be resolved in the state or federal courts of Delaware.
